Terms
Last updated: October 14th 2026
These Terms are a contract between you and Fireflow Creative Collective. Please read section 12 and section 15, which limit our liability and set out how disputes are resolved.
What changed on October 14, 2026
- Eagle Eye. Section 1 now lists Eagle Eye, our zoom photo enhancer. A new section 9 covers what is particular to it: results are redrawn by an AI model, the photos you send stay yours, and what you may not use it for. Section 6 explains how its weekly usage works.
What changed on September 25, 2026
- Lifetime and one-time purchases. A new part of section 6 explains what a lifetime or one-time purchase includes and how long it lasts: for as long as we offer and support the app. See Lifetime and one-time purchases.
- Features can change. Section 8 now says plainly that we may add, change or remove features.
- Alarm reliability. Section 1 now lists our alarm apps together, including Rise in Grace, and section 7 applies to all of them.
If you bought a lifetime or one-time unlock before September 25, 2026, these changes affect you. They apply to your purchase from October 26, 2026. Until then, the Terms as they stood when you bought continue to apply. If you have questions, write to info@thesunrise.org. Nothing here affects your statutory rights.
1. Who we are, and what these Terms cover
The Sunrise is a project operated by Fireflow Creative Collective (“we”, “us”, or “our”), a company based in San Francisco, California, United States. Contact: info@thesunrise.org.
These Terms govern your use of:
- Our alarm apps: Bird Rise, Memo Rise, Moon Rise, Rise in Grace, and any other alarm app we publish under the Sunrise name (together, “our alarm apps”)
- Blurry Birds, on the web and as an iOS app
- Eagle Eye, the zoom photo enhancer for iPhone
- The browser games at thesunrise.org/app/
- Other Sunrise-branded apps and services
- The website at thesunrise.org
By downloading, accessing or using any of them, you agree to these Terms. If you do not agree, do not use them.
How we handle personal data is described in our Privacy Policy and Cookie Policy, which form part of these Terms.
2. Who may use them
You must be old enough to enter into a contract where you live. If you are under 18, you may use our apps only with the involvement of a parent or guardian, who accepts these Terms on your behalf.
You must also be at least 13, or 16 in the European Economic Area and the United Kingdom where your country applies that higher age, unless a parent or guardian has consented as described in the Privacy Policy.
3. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use our apps and websites for your own non-commercial purposes, on devices you own or control, in accordance with these Terms and the App Store’s Usage Rules.
You agree not to:
- Misuse or interfere with the apps, the websites, or the systems that serve them
- Reverse engineer, decompile, disassemble, copy, rent, lease, lend, sell, redistribute or sublicense them, except where that restriction is prohibited by law
- Remove or obscure any copyright, trademark or other notice
- Use them in any unlawful or harmful way, or to infringe anyone’s rights
We reserve every right not expressly granted here.
4. Accounts
Most Sunrise apps do not require an account. Your alarms, settings and history live on your device and are linked to an anonymous identifier described in section 2 of the Privacy Policy.
If an app introduces optional accounts or sign-in in the future, additional terms may apply and we will present them at the time.
5. Voice recordings (Memo Rise)
Memo Rise lets you record your own voice for use as an alarm.
You retain full ownership of your recordings, and you are responsible for what you record. We do not claim ownership, and we do not access, upload or use them outside the app’s intended functionality. They stay on your device.
6. Subscriptions, purchases and cancellation
Some apps offer paid features, subscriptions and one-time purchases. Payment is taken by Apple through your App Store account, not by us. We never see your payment details.
Before you buy, the app and the App Store listing show the exact price in your local currency, the length of the subscription period, and the length of any free trial. By subscribing, you agree to the following.
- It renews automatically. Your subscription continues, and your App Store account is charged for another period, unless you cancel.
- When you are charged. Apple charges your account for the renewal within the 24 hours before the current period ends, at the price then shown for your plan.
- How to cancel. Cancel at least 24 hours before the current period ends, in iOS Settings > your name > Subscriptions, or in the App Store app. Cancelling stops the next charge; you keep access until the end of the period you already paid for. Deleting the app does not cancel a subscription.
- Free trials. If you buy a subscription during a free trial, any unused part of the trial ends at that moment.
- Price changes. If we change the price of a plan you are on, Apple will notify you and, where the law requires, ask you to confirm before the new price applies. You can cancel instead.
- Refunds. Refunds are handled by Apple under its own policy, at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves, though we will help where we can.
- Usage in Eagle Eye. An Eagle Eye subscription refills an allowance of usage at the start of each billing period, and the app shows how much is left. Unused usage expires at the end of the period and does not carry over. A larger result, such as 4K, uses more than a smaller one, and an enhance that does not come back uses none. The free usage a new install starts with is given once per device, and neither it nor a subscription’s allowance has any cash value or can be transferred.
Lifetime and one-time purchases
A lifetime or one-time purchase unlocks the paid features of that app, as described at the time you buy, for as long as we continue to offer and support the app. It is not a subscription and does not renew. It does not include separate apps, or new features or services we choose to offer separately. If we discontinue the app, or it is transferred to a new owner under section 17, section 8 applies. For purchases made before September 25, 2026, this part takes effect on October 26, 2026. Nothing here affects your statutory rights.
Your right to cancel, for consumers in the EU, the EEA and the UK
You normally have 14 days to withdraw from a purchase of digital content without giving a reason. Because our apps give you immediate access to the paid features, you will usually be asked to agree that supply begins straight away, which means the withdrawal right ends once supply has begun. Where the right does still apply, exercise it through Apple at reportaproblem.apple.com, or contact us at info@thesunrise.org and we will help you do so.
Nothing here affects your statutory rights, including the right to a remedy if the digital content is faulty or not as described.
7. Alarm reliability
Our alarm apps (listed in section 1) schedule alarms through iOS system services, including AlarmKit and local notifications. Whether an alarm sounds at the scheduled time depends on your device and its operating system, including Focus and Do Not Disturb modes, silent mode, battery and background activity settings, notification and alarm permissions, system updates, and available storage. These are controlled by iOS and by your device settings rather than by us, and we cannot guarantee that any individual alarm will sound.
You are responsible for configuring your device so that alarms can play, and for using an independent backup alarm for any wake-up you cannot afford to miss.
8. Availability and changes
We aim to keep our apps and websites available and reliable, but we do not guarantee uninterrupted access. We may add, change or remove features and content, and suspend or discontinue an app or service.
Where a change significantly affects your use, we will give reasonable notice. If we discontinue a paid app or feature you are subscribed to, you can cancel as described in section 6. Any refund is Apple’s to make under its own policy, and nothing here affects your statutory rights.
9. Enhanced photos (Eagle Eye)
Results are redrawn, not recovered. Eagle Eye sharpens a photo by having an AI image model, Google’s Gemini, redraw it. The model works out what fine detail was probably there; it cannot know. A result can add, change or leave out details, including text, markings, faces and the number or shape of things, and it is not a faithful record of what was in front of the camera. Do not rely on an enhanced photo as evidence, for identification, or for any legal, scientific, medical or safety purpose. Hold a result to compare it with the original before you keep it.
Your photos stay yours. You keep every right you have in the photos you enhance and in the results. You give us only the permission we need to send a photo to the model, return the result to you and, if you report a result, keep it for the time set out in the Privacy Policy. We do not use your photos to train anything.
Your original. A result is saved over the photo in your library, and the Photos app keeps the original so you can revert to it. Reverting is done in the Photos app, and Eagle Eye cannot bring back an original you have deleted or one Photos no longer keeps.
What you may not enhance. Only enhance photos you have the right to use. You may not use Eagle Eye:
- on a photo of another person without their permission, or to identify, track or watch someone
- on sexual content involving anyone under 18, or any sexual content of a real person without their consent
- to make an image that passes off as real something that did not happen, in order to deceive or harm anyone
- in any way that breaks the law or Google’s Generative AI Prohibited Use Policy, which applies to every request sent to the model
We may refuse a request, and section 15 applies if you break these rules.
10. Intellectual property
All Sunrise apps, games, designs, logos, text, audio, images and software are owned by Fireflow Creative Collective or its licensors and are protected by copyright, trademark and other laws. You may not use our branding, trademarks or content without prior written permission.
Some bird photographs and recordings are used under Creative Commons or similar licences, and are credited on the relevant page and in the app’s Credits screen.
Copyright complaints. If you believe material on our website or in our apps infringes your copyright, send a notice under the Digital Millennium Copyright Act to info@thesunrise.org with the subject “DMCA”. Include your contact details, identification of the work, the URL or location of the material, a statement that you have a good-faith belief the use is unauthorised, a statement under penalty of perjury that the notice is accurate and that you are authorised to act, and your signature. We will respond promptly and remove or disable material where appropriate.
11. Third-party services and content
Our apps and websites rely on third-party services, including Apple, Mixpanel, Meta, RevenueCat, Google and Cloudflare, and link to third-party sites and content. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services or content outside our control.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR APPS, GAMES AND WEBSITES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the apps will meet your requirements, that they will be uninterrupted, timely, secure or error-free, or that any alarm or notification will function without interruption. See section 7. Nor do we warrant that a photo enhanced by Eagle Eye will be accurate or suitable for any purpose. See section 9.
Some jurisdictions do not allow the exclusion of implied warranties, so some or all of this section may not apply to you. If you are a consumer in the European Economic Area or the United Kingdom, this section does not limit your statutory rights.
13. Limitation of liability
To the fullest extent permitted by law, Fireflow Creative Collective shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill.
In addition, our total aggregate liability for all claims arising out of or relating to the apps, whether in contract, tort (including negligence), or otherwise, shall not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
14. Indemnification
You agree to indemnify and hold harmless Fireflow Creative Collective and its officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the apps or websites, or your infringement of any third-party right. This does not apply to the extent the claim arises from our own breach or negligence, and it does not apply where you are a consumer and the law does not permit it.
15. Termination
You may stop using our apps at any time by deleting them from your device. Remember that deleting an app does not cancel a subscription; see section 6.
We may suspend or terminate your access if you breach these Terms, or if we are required to by law. Sections 5, 8, 10, 12, 13, 14 and 16 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, this choice of law does not deprive you of the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of that country. The rest of this section does not apply to you. You may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
For everyone else, the following applies.
- Talk to us first. Before starting any formal proceeding, email info@thesunrise.org describing the dispute. We will try to resolve it informally within 30 days.
- Small claims. Either of us may bring an individual claim in small claims court instead, and we would usually prefer that.
- Arbitration. Otherwise, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in San Francisco, California, or by video or telephone, or in the county where you live, at your choice. Judgment on the award may be entered in any court with jurisdiction.
- No class actions. Claims must be brought individually, and not as a plaintiff or class member in any class, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over a class proceeding.
- You can opt out. You may reject this arbitration agreement by emailing info@thesunrise.org with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms. Opting out does not affect anything else here.
If the class-action waiver is found unenforceable for a particular claim, that claim is severed from arbitration and heard in the courts of San Francisco County, California, and both of us consent to jurisdiction there.
17. The App Store
The following applies to apps you obtain from Apple’s App Store, and it is what makes these Terms the licence agreement for those apps.
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the apps and their content.
- Your licence to use the app is the licence in section 3, limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the App Store’s Usage Rules.
- Apple has no obligation to furnish any maintenance or support for the apps.
- To the extent permitted by law, Apple has no warranty obligation at all. If an app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the apps, including product liability claims, claims that an app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that an app infringes that third party’s intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
- Contact for questions, complaints or claims: Fireflow Creative Collective, San Francisco, California, United States, info@thesunrise.org.
18. General
If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between us about the apps and websites.
19. Changes to these Terms
We may update these Terms. Updated Terms are posted here with a new “Last updated” date, and continued use after that means you accept them. Where a change is material, we will give reasonable notice on this website before it takes effect.
